Terms of Service

1. Acceptance of Terms

By accessing or using CloudEchecks ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and CloudEchecks.

2. Description of Service

CloudEchecks provides a web-based platform for generating, managing, and printing business checks. The Service includes ABA routing number validation, digital signature capabilities, check template generation, bank profile management, and related administrative tools.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account. You must notify us immediately of any unauthorized use of your account. CloudEchecks is not liable for losses resulting from unauthorized account access due to your failure to protect your credentials.

4. Acceptable Use

You agree to use CloudEchecks only for lawful purposes. You may not: use the Service to generate fraudulent or unauthorized checks; misrepresent your identity or banking information; use the Service to commit financial crimes or money laundering; attempt to reverse-engineer, hack, or disrupt the platform; or violate any applicable local, state, federal, or international laws.

5. Financial Information

You are solely responsible for the accuracy of all banking information entered into the Service, including routing numbers, account numbers, payee names, and check amounts. CloudEchecks provides ABA routing validation as a convenience tool but does not guarantee the accuracy of banking databases or the successful clearing of any check generated through our platform.

6. Intellectual Property

The CloudEchecks platform, including all software, design, branding, and documentation, is the intellectual property of CloudEchecks and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the platform without our express written consent.

7. Limitation of Liability

CloudEchecks shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service, including but not limited to: bounced checks, bank fees, fraudulent transactions, or any financial losses arising from the use of generated checks. Our maximum liability to you shall not exceed the amount paid by you in the 12 months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, suspected fraudulent activity, or at our discretion with reasonable notice. Upon termination, your right to use the Service immediately ceases. You may export your data within 30 days of termination.

9. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the platform. Continued use of CloudEchecks after changes constitutes acceptance of the updated Terms. If you disagree with changes, you may terminate your account.

10. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the federal or state courts of the applicable jurisdiction. You agree to submit to personal jurisdiction in such courts.
